📑 GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

1. Premises

These General Terms and Conditions of Sale (hereinafter “GTCS”) govern the purchase of products carried out remotely through the website www.rarecollections.it (hereinafter the “Website”) by users qualifying as Consumers under Italian Legislative Decree 206/2005 (“Consumer Code”) and by Professionals or Businesses (B2B) under the Italian Civil Code.

The Website is managed by RareCollections S.R.L., with registered office at Corso d’Augusto 81, c/o Studio Sartini, 47921 Rimini (RN), Italy, VAT no. 04483790400, email: info@rarecollections.it, PEC: rarecollections@pec.it, tel: +39 351 6315003.

By accessing the Website and purchasing products, the user fully accepts these GTCS.

2. Subject

These GTCS regulate the terms and conditions of sale of the products offered by RareCollections S.R.L. through the Website.
The products offered for sale may be new, used, or refurbished by RareCollections S.R.L., and such condition is clearly indicated on each product page.

3. Purchase procedure and conclusion of the contract

  • To purchase a product, the user must select it, add it to the cart, and complete the order by following the guided procedure on the Website.

  • The order sent by the user constitutes a contractual proposal.

  • The contract is deemed concluded when the user receives the order confirmation email sent by RareCollections S.R.L.

4. Prices and tax regime

  • All product prices are expressed in Euro.

  • Depending on the type of product and the applicable tax regime, prices may:

    • include VAT at 22%, if applicable;

    • or be determined under the margin scheme (Articles 36 et seq., Italian Law Decree 41/1995), when goods are purchased from private individuals or non-VAT registered entities in Italy or the EU. In such cases, VAT is not deductible.

  • The applicable tax regime will be indicated exclusively on the invoice or quotation and will not be visible during the online purchase process.

  • Shipping costs and any additional charges are clearly indicated before the order is finalized.

  • Accepted payment methods include: credit/debit card, PayPal, bank transfer, and others as may be indicated on the Website.

5. Product trade-in (exchange)

  • RareCollections S.R.L. offers its customers the possibility of trading in used products as partial payment for the purchase of new products available on the Website.

  • The valuation of the product proposed for trade-in is carried out by RareCollections S.R.L. based on its condition, authenticity, and market reference.

  • Acceptance of the trade-in is at the sole discretion of RareCollections S.R.L. and becomes binding only upon written confirmation (including by email or quotation).

  • The value assigned to the traded-in product will be deducted from the purchase price of the new product or, alternatively, may be provided as a credit to be used for future purchases.

  • The products offered for trade-in must be of lawful origin: the customer guarantees to be their legitimate owner and to have full right of disposal. RareCollections S.R.L. reserves the right to request supporting documentation.

  • Any shipping costs related to the delivery of the product for trade-in are borne by the customer, unless otherwise agreed in writing.

6. Shipping and delivery

  • RareCollections S.R.L. ships to Italy and abroad using qualified couriers.

  • Delivery times and costs are specified during the purchase process.

  • For international shipments, any customs duties, import taxes, or clearance charges are the sole responsibility of the purchaser. RareCollections S.R.L. shall not be held liable for such costs or for delays caused by customs procedures.

  • RareCollections S.R.L. is not responsible for delays or service failures attributable to the courier or to force majeure events.

7. Right of withdrawal

  • Consumers (B2C): pursuant to Articles 52 et seq. of the Consumer Code, the Consumer has the right to withdraw from the contract within 14 days from delivery of the product, without having to provide any reason.

    • To exercise the right of withdrawal, the Consumer must send written notice to RareCollections S.R.L. via email (info@rarecollections.it) or PEC (rarecollections@pec.it).

    • The product must be returned intact, complete in all its parts, and in its original packaging.

    • RareCollections S.R.L. will refund the full amount paid (including standard shipping costs) within 14 days of receiving the withdrawal notice, using the same payment method used by the customer.

    • Return shipping costs are borne by the Consumer.

  • Business Clients (B2B): the right of withdrawal does not apply, unless otherwise agreed in writing between the parties.

8. Warranty

  • Consumers (B2C):

    • For new products, all goods sold are covered by the 24-month statutory warranty of conformity under the Consumer Code.

    • For used or refurbished products, the statutory warranty of conformity is reduced to 12 months, as permitted by Article 134 of the Consumer Code.
      This reduction is clearly indicated on the product page and disclosed to the Consumer before concluding the online purchase, through acceptance of these GTCS.
      It is therefore not necessary for it to be stated on the invoice or receipt, as it forms an integral part of the sales contract accepted at the time of order.

  • Business Clients (B2B):

    • For Business Clients, sales are governed by the Italian Civil Code and the warranty period is 12 months from delivery, both for new and used/refurbished products, unless otherwise agreed in writing.

9. Limitation of liability

  • RareCollections S.R.L. shall not be liable for indirect or consequential damages arising from improper use of purchased products.

  • RareCollections S.R.L. assumes no responsibility for any information provided by third-party manufacturers and reproduced on product pages.

10. Third-party products and trademarks

RareCollections S.R.L. sells original products purchased from companies and private individuals.
Any trademarks displayed on the Website belong to their respective owners and are used solely for descriptive and identification purposes.
Unless expressly stated otherwise, RareCollections S.R.L. has no affiliation, license, or official distribution relationship with trademark holders.

12. Governing law and jurisdiction

These GTCS are governed by Italian law.

  • For Consumers (B2C): the competent court is that of the Consumer’s place of residence or domicile.

  • For Business Clients (B2B): the exclusive competent court is Rimini, Italy.

13. Amendments

RareCollections S.R.L. reserves the right to amend these GTCS at any time. Amendments shall be effective as of their publication on the Website.
